COMMERCIAL LEASE & RETAIL SHOP LEASE

A commercial lease is for a commercial space, such as a factory or office space. In Queensland, commercial leases are primarily governed by the Property Law Act 1974 (Qld).

If you are leasing premises to use for retail purposes or if the premises are in a retail shopping centre (where five or more retail shops are located), it is likely that the retail shop leases legislation will apply to the lease. The retail shop lease legislation, including Retail Shop Leases Act 1994 (Qld) sets mandatory minimum standards for retail shop leases in Queensland and offers tenants more protection than standard commercial leases, such as specific disclosure obligations on the parties, turnover rent, options to extend, outgoings payable and recovery requirements, rent review mechanisms, trading hours, relocation and demolition procedures, dispute resolution and tenant compensation rights.

A lease is a contract that outlines the terms of possessing a property for a specified time at an agreed fee. Failing to understand your rights and the terms of your lease may cause you to breach your lease or lose important rights. Leases are legally binding so it is important to have a thorough check of the proposed lease before you sign it.

Due to the complexity of commercial leases and the Retail Shop Leases Act, it's advisable to seek legal advice before entering into any commercial lease agreement, especially if it involves a retail shop. We can help you to avoid expensive misunderstandings that could cost you money and your business.

IMMIGRATION LAW

Australian immigration law deals with immigration into and deportation from Australia. Immigration law relates to the act of entering a country with the intention of remaining there permanently. Australian immigration law is regulated by variety of Commonwealth law, namely:

  • Migration Act 1958;

  • Migration Regulations 1994;

  • Judiciary Act 1903 (s 39B); and
